What is probate?

Definition

Probate is the court process that confirms the validity of a will and the executor's authority; most provinces charge a fee or tax based on the value of the estate passing through it.

How it works in Canada

Financial institutions and land registries often require probate before transferring assets. Fees, timelines and terminology vary by province, and Quebec uses a different civil-law process, with notarial wills generally not requiring probate.
